    Bar Council of India resolves the problems of Govt. College of Maharashtra

     

    For the last several years repeated questions were raised for filling up vacancies of faculty members as per norms of Legal Education Rules 2008 by the State government in respect of government and government aided private law colleges including improvement of infrastructure in these institutions and also as also as to why the government is not issuing approval for appointment of faculty members to permanent unaided & self financed law colleges in Maharashtra.  For three consecutive years, assurance were being given by the colleges concerned and also by the government  that all the vacancies will be filled up with competent, qualified faculty and requisite infrastructure will be made available, but nothing was done.  Finally the Bar Council of India had to issue the direction not to admit students for session 2016-17 in some of such colleges for the  reason that sub standard law graduate should not be produced because of reluctance of the government  for not doing the needful.

     

    After the said resolution was taken, then Mr. Sitaram Kunte, Principle Secretary, Higher Education along with Director, Higher and Technical Education Department presented themselves before this committee with a request to withdraw the order of no admission and they promised to rectify the shortcomings pointed out earlier by this committee.

    However, the committee felt that such assurances had repeatedly been given in the past also, therefore, it is better that the government gives a written undertaking for the removal of the shortcomings and compliance of earlier directions.

     

    Today, the undertaking has been filed by the Government under which the Government has undertaken to appoint the requisite number of teachers as per Bar Council of India norms within six months and Government has also ensured that the infrastructure shall be made as per norms  provided by the Bar Council of India within one year. The undertaking is reproduced below:
    “ We are grateful to the Bar Council of India for giving us an opportunity to present the case of Legal Education in Maharasthra.  We were able to present various issues for the consideration of the council. We appreciate that the Bar Council of India is desirous of excellence in Legal Education. Government of Maharashtra is also committed to achieving excellence in Legal Education. To that end, Government is committed to take necessary actions for ensuring that proper standards are maintained in this regard.

     

    1. In compliance of the various letters and direction of Legal Education Committee of Bar Council of India, I Shri. Sitaram Kunte, Principal Secretary, Higher and Technical Education, Government of Maharashtra hereby undertaken to comply with the directions of Legal Education Committee and norms laid down by Bar Council of India with regard to the infrastructure and appointment of teachers in various Government and Government Aided Private law colleges of Maharasthra.

     
    ( a) State Government undertakes to appoint sufficient number of teachers as per the Bar Council of India norms (i.e. with the ratio of 1:40) within a period of six months, from today in respect of Government and Government Aided Private law colleges.

     
    (b) State Government undertakes to provide adequate infrastructure as per norms in Government Law College within one year from today.  It further undertakes to immediately direct the Principals and Managements of Government Aided private law colleges to ensure that infrastructure as per norms is provided in their institutions within one year from today.

     
    (c ) As regards to permanent unaided & self financed Law Colleges in Maharashtra similar instructions will be issued to their Principal and Managements to comply with the aforesaid regulations.

    In view of the aforesaid undertaking, the earlier order “not to admit students” in various colleges for the session 2016-17 stands withdrawn.  However, it is expected, the government would comply with the said undertaking so that no unpleasant consequential orders are passed for the session 2017-18.
