The information under 4 1(b) of the RTI Act, 2005

4 1(b) :

i). The particulars of the Bar Council of India and its functions and duties are given in the Website of the Bar Council of India, “www.barcouncilofindia.org” under the heading “About the Council”.

ii).   The matters of legal education are considered by the Legal Education Committee headed by Former Judge, Supreme Court of India and disciplinary matters are considered by the various  Disciplinary Committees and other matters / recommendations by the above said committees are considered by the General Council of the Bar Council of India. The duty of the officers of the Bar Council of India is to execute the order of the General Council of the Bar Council of India.

The list of the officers and other staff are given in the above     said website under the heading “Officer”.

iii).   The departments of the Council are Council Department, Legal Education Department, Disciplinary Committee department, AIBE (All India Bar Exam) department, Accounts Department, and Bar Council of India Trust.

The Council Department has Writ Department, Revision & Petition Department, and etc.

All the Council related matters as mentioned under Section 7 of the Advocates Act, 1961 are considered by the General Council of the Bar Council of India. The documents / matters received by the Receipt section of the Bar Council of India will be placed before the Secretary, Bar Council of India. Then the Secretary will direct concerned staff to dispatch to the HOD of the concerned departments after proper entry in the ledger.

Then the Secretary of the Bar Council of India will prepare an agenda and notes on all the matters related to the Council, Legal Education, Executive Committee and other Committees etc and place it before the General Council, Legal Education Committee and other Committees respectively.

After consideration by the concerned Committees, the recommendations will be placed before the General Council for its consideration. After passing an order by the General Council, the Secretary will communicate to the concerned.

The Accounts department will look after the inspection fees, welfare funds and other miscellaneous fees.

iv). Norms of BCI to discharge of its function is laid down in the Rules of the Bar Council of India Rules & Rules of LegalEducation Rules-2008, which are given in the above said website.

v). The Rules of the Bar Council of India and Rules of Legal Education Rules-2008 are given in the above said website.

vi). The documents / decisions / proposals of the various State Bar Councils, files of disciplinary  proceedings, applications / compliance reports of law colleges for approval, inspection reports of the law institutions, Minutes of the various meetings, transfer applications of advocates, writ petitions filed against the Bar Council of India, revisions and petitions related to the Council, welfare funds submitted by the various State Bar Councils, personal files of employees of the Council, etc

vii). The Bar Council of India is a statutory body consists of 22 members. Twenty members are elected from various State Bar Councils and Attorney General of India and Solicitor General of India are Ex-Officio members. Any rules regarding the legal profession are consulted with all the State Bar Councils, any rules related to the Legal Education will be implemented after consultation with the stake holders (State Bar Councils and Universities imparting legal education in India). The Council had also various Committees involving members from Judiciary, legal profession, Academics, and various fields whenever it requires.

viii).  The details are given under Section 8A, 9, 9A, 10 and 10 A in the Advocates Act, 1961 which is given in the above said website.

x). As per the 7th Pay Commission provided for Central Government employee, the monthly remuneration received by the each employees of the Bar Council of India. The employees details are already given under the heading “Officer” in the website of the Bar Council of India.

xi). All income and expenditure of BCI are audited by Statutory Auditor every year and same is published in Gazette Notification.

xii). The Bar Council of India conducts conferences, seminars, continuing legal educations programmes in association with State Bar Councils, Bar Associations and law institutions. According to the programme and request from the concerned authorities, the Council allots the funds.

xiii). Four students of Odisha National Law University have been provided Rs. 1.5 lakhs each to attend International Moot Court Competition on 26.12.2019.
